Happy Day (“we”, “us”, “our”) operates happyday.ink, an AI-powered greeting card platform based in South Africa. We comply with the Protection of Personal Information Act (POPIA) of South Africa and act as the responsible party for processing your personal information.

Information We Collect

We collect the following types of information:

• Account information: your name and email address when you create an account or place an order.
• Order information: delivery address, billing details, and order history when you purchase a printed card.
• Card content: photos, text, and design choices you upload or create while using our card designer.
• Reminder information: the names, dates and occasions you save to your reminder list.
• Technical information: IP address, browser type, device, and pages visited, collected automatically through cookies and analytics tools.

How We Use Your Information

• To process your orders and deliver your cards
• To generate AI artwork based on your design choices
• To send you order confirmations, delivery updates and occasion reminders
• To provide customer support
• To improve our service and measure how it is used
• To send marketing communications (only if you’ve opted in)

Your Photos and AI Generation

Your reference photos are sent to our trusted AI providers only to generate your card. Our paid agreements with these providers prohibit them from using your photos or generated cards for any other purpose, including training their AI models. Photos are not retained beyond brief security logging required by their terms.

Sharing Your Information

We do not sell your personal information, and we do not share your personal details with third parties for marketing purposes. We do share limited information with the following service providers strictly to deliver our service:

• AI providers (Google Gemini and OpenAI): we share the card design content (photos, descriptions, style selections) needed to generate your artwork. We do not share your name, email, or any personal account information with them.
• Payment processors: payment details are handled directly by our payment gateway and never stored on our servers.
• Email delivery (Postmark): we use Postmark to send order confirmations, reminder emails, and account-related messages.
• Courier partners: for printed orders, we share the delivery name and address with our courier so they can deliver your card.

Cookies and Analytics

We use the following tracking tools on our website:

• Google Analytics: to understand how visitors use our site and improve the experience.
• Meta Pixel: to measure the effectiveness of our advertising and show relevant ads to people who’ve visited our site.
• Essential cookies: to keep you logged in, remember your cart, and track guest credits and saved card designs.

You can disable non-essential cookies at any time through your browser settings.

Marketing Communications

We will only send you marketing emails — things like seasonal reminders, free generations, and occasional offers — in the following situations, in line with section 69 of the Protection of Personal Information Act (POPIA):

• Registration or account preferences: you’ve explicitly ticked the marketing box on the signup form, or turned marketing on from your My Account page. This is unticked by default — we only send if you actively opt in.
• After a purchase: you’ve bought from us and didn’t untick the marketing opt-in box at checkout. This relies on POPIA’s existing-customer exception: we can send you marketing for similar products unless you’ve asked us not to, and the checkout box is your chance to object at the point of collection.

Transactional emails — order confirmations, delivery notifications, password resets, account verification, and reminders you’ve set up yourself — are not marketing, and we’ll send them regardless of your marketing preference.

You can unsubscribe from marketing at any time by clicking the unsubscribe link in any marketing email, toggling the preference on the My Account page, or emailing us directly. Once you’ve unsubscribed, we won’t silently re-enrol you: future checkout boxes will render unticked so you have to make an active choice to opt back in.

Data Retention

We retain your account information and order history for as long as your account is active, and as required to comply with our legal and tax obligations. Saved card designs are kept so you can re-order them in future. You can request deletion of your account and data at any time.

Your Rights Under POPIA

As a data subject in South Africa, you have the right to:

• Access the personal information we hold about you
• Correct any information that is inaccurate or incomplete
• Request deletion of your personal information
• Object to the processing of your personal information for marketing purposes
• Lodge a complaint with the Information Regulator of South Africa

Security

We take reasonable technical and organisational measures to protect your information from unauthorised access, loss, or misuse. All payment transactions are encrypted and processed through secure, PCI-compliant payment gateways.

We may update this policy from time to time. The latest version will always be available on this page. Material changes will be communicated by email where appropriate.
